TERMS AND CONDITIONS

These Terms and Conditions ("Terms") are a legally binding agreement between you and KODARA LLC, a Florida limited liability company doing business as The Zodiac Spot ("The Zodiac Spot," "we," "us," or "our"). They govern your access to and use of https://thezodiacspot.com and the products and services offered through it (collectively, the "Services").

By using the Services or placing an order, you agree to these Terms and the policies linked from them. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract to use or purchase through the Services. You are responsible for providing accurate information, protecting your account credentials, and all activity under your account. We may suspend or close an account used fraudulently, unlawfully, or in violation of these Terms.

2. Our products and Services

The Zodiac Spot creates personalized astrology charts and artwork and sells digital downloads and made-to-order printed products. Product availability, designs, materials, sizes, prices, and features may change. We make reasonable efforts to display products accurately, but screen settings, production methods, material texture, cropping, and normal manufacturing tolerances can cause minor differences in color, scale, placement, or appearance.

A chart preview is provided to help you review the design and personalization. A preview may be watermarked, reduced-resolution, or scaled for display. The final production or digital file may be rendered at a different resolution or aspect ratio while preserving the selected design and submitted information.

3. Personalization information

You are responsible for carefully reviewing all names, spellings, birth dates, birth times, birth locations, addresses, sizes, finishes, frame choices, and other selections before placing an order. Birth time and location can materially affect an astrology chart. We are not responsible for an inaccurate result caused by inaccurate, incomplete, or incorrectly entered customer information.

If the finished product does not match the information shown in your order confirmation because of an error by us or our provider, contact us under our Refund and Return Policy.

4. Orders, pricing, and payment

• Prices are displayed and charged in U.S. dollars unless checkout clearly states otherwise.
• Taxes, shipping, and other applicable charges are shown at checkout before you place the order.
• Payments are processed by Stripe or another payment method displayed at checkout. You authorize the payment processor to charge the amount shown.
• An order is not accepted until payment is authorized and we send an order confirmation. An automated confirmation does not prevent us from canceling an order for fraud, pricing error, unavailability, unsupported delivery location, or another legitimate reason.
• If we cancel a paid order, we will issue the refund required by applicable law and our posted policies.

5. Digital products

Digital products are delivered electronically after payment and successful file generation. Delivery may not be instantaneous when a personalized file must be rendered. You are responsible for providing a working email address and maintaining access to your account or download link.

Unless a product page expressly grants broader rights, a digital purchase gives you a limited, revocable, non-exclusive, non-transferable license to download and print the file for your own personal, non-commercial use. You may not resell, sublicense, redistribute, upload for public access, use as a template for products sold to others, remove ownership notices, or commercially exploit the file or design.

6. Physical production, shipping, and delivery

Physical products are made to order and may be produced and shipped by a print-on-demand fulfillment provider, currently Printful. Production and delivery dates are estimates, not guarantees. Orders with multiple items may arrive in separate packages. Carrier delays, weather, customs, address problems, and events outside our reasonable control can affect delivery.

Physical products currently ship only to supported United States addresses unless checkout expressly offers another destination. You are responsible for a complete and accurate shipping address. Additional charges may apply when a package is returned, refused, unclaimed, or requires reshipment because of an address supplied by the customer. Additional terms appear in our Shipping Policy.

7. Cancellations, returns, refunds, and replacements

Personalized and made-to-order products are created specifically for the customer. Change-of-mind returns and exchanges generally are not accepted. Cancellation or modification is not guaranteed after an order enters production or digital rendering begins.

Damaged, defective, misprinted, incorrect, lost, or incorrectly generated orders are handled according to our Refund and Return Policy, subject to applicable law. Do not mail a product to any address unless we first provide instructions.

8. Astrology and entertainment disclaimer

Astrology charts, interpretations, artwork, descriptions, and related content are provided for personal, artistic, informational, and entertainment purposes. They are interpretive and subjective. They are not medical, mental-health, legal, financial, tax, employment, relationship, or other professional advice and should not be used as a substitute for qualified professional advice or as the sole basis for an important decision. We do not guarantee a particular outcome, prediction, compatibility result, or interpretation.

9. Intellectual property

The Services, software, chart layouts, artwork, graphics, text, logos, product designs, and other content are owned by or licensed to KODARA LLC and are protected by intellectual-property laws. Except for the limited personal-use license granted with an eligible purchase, no rights are transferred to you.

You may use ordinary Website pages for personal shopping and may share links to publicly available pages. Without our written permission, you may not copy, scrape, reproduce, modify, publish, sell, reverse engineer, create derivative commercial products from, or systematically extract the Services or their content. 10. Customer submissions and reviews

You retain ownership of original content you submit, but you grant us a limited license to host, process, reproduce, adapt, and transmit it as necessary to provide the requested Services, fulfill the order, provide support, prevent fraud, and comply with law. You represent that you have the right to submit the content and that it does not violate another person's rights or applicable law.

If you voluntarily submit a public review or testimonial, you grant us a non-exclusive, worldwide, royalty-free license to display and reasonably format it with the name or initials you chose to publish. We will not publicly use private birth details or order information as a testimonial without separate permission.

11. Prohibited use

You may not:

• Use the Services for unlawful, fraudulent, abusive, infringing, or deceptive activity.
• Attempt to bypass payment, download authorization, access controls, rate limits, or security measures.
• Upload malicious code, interfere with the Website, probe for vulnerabilities, or access another person's account or data.
• Use bots or scraping tools in a way that burdens the Services or extracts content or data without permission.
• Submit another person's personal information without appropriate authority.
• Misrepresent a chart or other content as professional advice or as a guaranteed prediction.

12. Third-party services

The Services rely on third parties for payments, hosting, maps, time-zone resolution, astrology calculations, rendering, file storage, email, analytics, security, fulfillment, and shipping. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or for events outside our reasonable control, but we remain responsible for obligations that applicable law places on us as the seller.

13. Privacy

14. Availability, corrections, and changes

We may correct errors, update content, change or discontinue a feature or product, limit quantities, or perform maintenance. We do not guarantee that the Services will always be uninterrupted or error-free. We will not change the material terms of an accepted order without your agreement, except as needed to correct an obvious error, prevent fraud, comply with law, or provide an equal or better remedy.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Website and non-product content are provided "as is" and "as available." We disclaim implied warranties to the extent they may lawfully be disclaimed. This section does not exclude any warranty, consumer right, or remedy that cannot legally be excluded, including rights relating to defective or incorrectly supplied goods.

16. Limitation of liability

To the fullest extent permitted by law, KODARA LLC and its officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the Services. Our aggregate liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim, except where applicable law does not permit that limitation. Nothing in these Terms limits liability for fraud, willful misconduct, or another liability that cannot lawfully be limited.

17. Indemnification

To the extent permitted by law, you agree to reimburse KODARA LLC for reasonable losses and expenses arising from your unlawful use of the Services, your infringement of another person's rights, or content you submit without the required rights. This obligation does not apply to losses caused by our own negligence, willful misconduct, or breach.

18. Governing law and disputes

These Terms are governed by Florida law, without regard to conflict-of-law rules, except that mandatory consumer laws in your place of residence may still apply. Before filing a claim, you and KODARA LLC agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice. If the dispute is not resolved, it may be brought in a state or federal court with jurisdiction in Florida, unless applicable law permits or requires another venue.

19. Electronic communications

You agree that order confirmations, receipts, disclosures, notices, and other communications may be provided electronically. You are responsible for maintaining a valid email address. Promotional email is optional and may be unsubscribed from; necessary order and account communications are not promotional.

20. General terms

These Terms and the policies incorporated by reference are the entire agreement concerning the Services. If one provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written permission; we may assign them as part of a reorganization, financing, merger, sale, or transfer of the business. Headings are for convenience only.

21. Changes to these Terms

We may update these Terms prospectively. The date at the top shows the latest revision. Material changes may be communicated through the Website or by email when appropriate. The Terms in effect when you place an order govern that order unless a change is required by law or you agree otherwise.
